Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Styled by Alhambra mobile application and website (the "Service") operated by Styled by Alhambra LLC ("Company", "we", "us", or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this minimum age requirement. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password confidential and notify us immediately at Sarahelchantaf@styledbyalhambra.com of any unauthorized use of your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to terminate accounts that contain false information or that violate these Terms.

3. License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. This license does not include the right to:

• Modify, reproduce, distribute, or create derivative works of the Service or its content.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use automated tools (bots, scrapers, crawlers) to access or collect data from the Service.
• Resell or sublicense access to the Service to third parties.

4. Apple End User License Agreement (EULA)

If you access the Service through the Apple App Store, the following additional terms apply. You acknowledge and agree that:

• These Terms are concluded between you and Styled by Alhambra LLC only, and not with Apple Inc. Apple is not responsible for the Service or its content.
• Apple has no obligation to furnish any maintenance or support services with respect to the Service.
• In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the Service. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Service.
• Apple is not responsible for addressing any claims you or any third party may have relating to the Service, including product liability claims, consumer protection claims, or intellectual property infringement claims.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

5. User-Generated Content

The Service allows you to upload content including photos, descriptions, tags, and listings ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, distribute, and display your User Content solely to provide and improve the Service.

You represent and warrant that:

• You own or have the necessary rights to the User Content you submit.
• Your User Content does not infringe the intellectual property, privacy, or other rights of any third party.
• Your User Content complies with these Terms and all applicable laws.

6. Prohibited Conduct

You agree not to use the Service to:

• Upload, post, or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Harass, bully, intimidate, or harm any other user.
• Impersonate any person or entity or misrepresent your affiliation with a person or entity.
• Post false, misleading, or fraudulent listings or product descriptions.
• Distribute spam, chain letters, or unsolicited commercial communications.
• Upload malware, viruses, or any code designed to disrupt or damage the Service.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Violate any applicable local, state, national, or international law or regulation.

7. Content Moderation & Reporting

We are committed to maintaining a safe and respectful community. We reserve the right to remove any User Content that violates these Terms, without notice or liability to you.

Reporting mechanism: If you encounter content that violates these Terms or that you believe is abusive, harmful, or illegal, you may report it by:

• Using the in-app "Report" feature available on any listing or user profile.
• Contacting us at Sarahelchantaf@styledbyalhambra.com with the subject line "Content Report."

We will review all reports and take appropriate action, which may include removing content, suspending accounts, or referring matters to law enforcement. We aim to respond to reports within 5 business days.

8. Resale Marketplace

The Service may include features enabling users to list clothing items for resale. You acknowledge that:

• Styled by Alhambra LLC acts as a platform facilitator and is not a party to any transaction between buyers and sellers.
• You are solely responsible for the accuracy of your listings, including item condition, sizing, and photographs.
• All sales are between users. We do not guarantee the quality, safety, or legality of listed items.
• You must not list counterfeit, stolen, or prohibited items. Violation may result in immediate account termination and referral to law enforcement.

9. AI Styling Features

The Service uses artificial intelligence to provide personalized styling recommendations. You acknowledge that:

• AI recommendations are provided for informational and inspirational purposes only and do not constitute professional fashion or personal styling advice.
• The accuracy and relevance of AI recommendations depend on the information you provide. We are not liable for outcomes based on AI-generated suggestions.
• We may use aggregated, anonymized wardrobe and preference data to improve our AI models.

10. Intellectual Property

All content included in or made available through the Service — including but not limited to the Styled by Alhambra name, logo, software, text, graphics, images, and the selection and arrangement thereof — is the exclusive property of Styled by Alhambra LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not use any Company trademarks without our prior written permission.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STYLED BY ALHAMBRA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS YOU PAID TO US IN THE PAST 12 MONTHS.

13. Indemnification

You agree to indemnify, defend, and hold harmless Styled by Alhambra LLC and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall first be submitted to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Dallas, Texas under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, providing in-app or email notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service and may delete your account per the process described in our Privacy Policy.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. Sections 10 (Intellectual Property), 11 (Disclaimer), 12 (Limitation of Liability), 13 (Indemnification), and 14 (Governing Law) survive any termination.
